Terms and conditions

1. Introduction

Welcome to Oasis Road. By accessing and using our website, you agree to be bound by the following Terms and Conditions. If you do not agree with these terms, please do not use our website.

2. Eligibility

To rent a motorcycle or scooter from Oasis Road, you must:

  • Be at least 21 years old for motorcycles.
  • Be at least 18 years old for scooters with an engine capacity of 49CC.
  • Hold a valid driving license for at least 2 years (for motorcycles) or the necessary license for scooters.
  • Provide necessary identification and documentation as requested.

3. Rental Agreement

When renting a motorcycle or scooter from Oasis Road, you must sign a rental agreement that outlines the specific terms of your rental, including payment, insurance, and responsibilities.

4. Prices and Payment Method

  • The prices for the VEHICLE RENTAL service are published on the Site and are effective as of the time of your Booking. The VEHICLE RENTAL cost will be confirmed in the Reservation Voucher.
  • If the Booking price has not been properly registered during your Booking, you will receive an additional notification regarding any change in the pricing. You may then accept or cancel the Booking through the Site. If a Booking is cancelled, we will refund the Booking Deposit in full but will not pay any additional compensation to you.
  • The VEHICLE RENTAL price is stated in the Reservation Voucher, which forms an inseparable part of the Rental Agreement.
  • Upon signing the Rental Agreement with Oasis Road, in addition to the balance of the rental price due, Oasis Road may request payment for any additional services that you have requested, including, without limitation, VEHICLE insurance, additional helmets, etc.

5. Pick-Up and Return of the Vehicle

  • Condition of Vehicle: The VEHICLE will be delivered to you in good technical condition with the equipment and appearance described in the Inspection Report, which will form part of the Rental Agreement. When you return the VEHICLE, its condition must be the same as set out in the Inspection Report. Missing items and damage to rental equipment are not covered by insurance, and you will be responsible for the full replacement cost. If the VEHICLE is returned unclean, you will pay all cleaning costs.
  • Collection: You will collect the VEHICLE at the place and time specified in the Reservation Voucher. Oasis Road may terminate your Rental Agreement if you fail to collect the VEHICLE within 2 hours of the specified collection time. If you fail to find a representative at the meeting point, you should immediately call Oasis Road using the contact details provided in the Reservation Voucher. If a call or email is not registered, your Booking will be deemed canceled, and you will not be entitled to compensation and will be responsible for payment of the full amount of the Booking.
  • Liability for Delays: Oasis Road will not be liable for losses suffered by you as a result of delay when collecting or returning the VEHICLE.
  • Documentation: Upon collection of the VEHICLE, you will present a valid driving license, a valid identity document (a national ID card or passport), and a valid credit card in your name. In some countries, an International Driver’s License (IDL or IDP) may be required by law. If you are unable to provide the necessary documents and a valid credit card, the Booking will be considered canceled, and you will pay the full amount as compensation.
  • Return: You will return the VEHICLE in the same condition as collected, with all vehicle documents, at the agreed time and place specified in the Rental Agreement. The return time and place must be confirmed with Oasis Road at least 24 hours in advance. Oasis Road will not be liable for losses due to delays in returning the VEHICLE.
  • Late Return: If you delay the return of the VEHICLE by more than 60 minutes from the agreed time, you will pay a default fee equivalent to 1 day’s rental. A delay of more than 2 hours may result in the Rental Agreement being voided, and standard daily rates may be applied if they are higher than the original Rental price.
  • Failure to Return: Failure to return the VEHICLE within 24 hours of the agreed time will be considered a misappropriation of the VEHICLE, and Oasis Road may inform the relevant authorities. Upon eventual return, you will pay the full daily rental amount from the contractual return date to the actual return date.
  • Termination of Rental: Oasis Road reserves the right to discontinue the Rental and collect the VEHICLE at any time, without notice and at your expense, if the VEHICLE has not been used in accordance with these Terms or the Rental Agreement. Oasis Road is not responsible for additional costs incurred due to the termination of the VEHICLE RENTAL.
  • Disruptive Behavior: Oasis Road reserves the right to withhold the VEHICLE RENTAL if you or your party’s behavior is disruptive or affects the safety of third parties. Oasis Road bears no responsibility for additional costs incurred due to withholding the VEHICLE RENTAL.
  • Inspection Report: If you fail to sign the Inspection Report upon return of the VEHICLE, it will be signed unilaterally by Oasis Road’s representative and a witness. The findings in the Inspection Report will be binding and can be used as evidence in court proceedings.
  • Vehicle Failure: If the VEHICLE fails to operate due to a manufacturing defect or natural wear and tear, Oasis Road will repair or replace the VEHICLE. If no suitable replacement is available, you will be provided with transportation to the return point, and the full Booking amount will be refunded. No further compensation will be due.
  • Vehicle Replacement: In case of damage caused by you, you will be responsible for all costs related to the replacement of the VEHICLE and the rental cost for the out-of-service period. Oasis Road may refuse a replacement VEHICLE if you are found to have breached these Terms or the Rental Agreement.

6. Insurance

Oasis Road provides insurance that covers third-party damages. The renter is responsible for any damages to the motorcycle or scooter caused by negligence, intoxication, or improper use.

7. Use of the Motorcycle or Scooter

The vehicle must be used in accordance with the rental agreement:

  • It cannot be used for commercial transport, races, or by anyone under the influence of alcohol or drugs.
  • Only authorized persons may drive the vehicle.
  • The renter is responsible for maintaining the vehicle in good condition and must return it in the same condition as received.

8. Liability

Oasis Road is not liable for any injuries, accidents, or damages incurred while using our rental vehicles, except as covered by the insurance policy.

9. Cancellations and Modifications

  • Cancellations must be made at least 48 hours before the rental period begins.
  • Any modifications to the rental period must be requested 48 hours in advance and confirmed in writing.

10. Privacy

Your personal information is protected in accordance with our Privacy Policy. By using our website and services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

11. Intellectual Property

All content on the Oasis Road website, including text, graphics, logos, and images, is the property of Oasis Road and is protected by intellectual property laws. You may not use any content from our website without our written consent.

12. Governing Law

These Terms and Conditions are governed by the laws of Morocco. Any disputes will be resolved in the courts of Marrakech.

13. Changes to Terms

Oasis Road reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of the website constitutes your acceptance of the new terms.
